Acceptable Use Policy

Please read this Acceptable Use Policy ("AUP") carefully. It governs your access to and use of the Gentia services, including any websites and mobile or desktop applications (collectively, the "Services"). By accessing or using the Services — or continuing to access them after receiving notice of a change to this AUP — you confirm that you have read, understand, and agree to be bound by this AUP.
Who We Are
Gentia provides psychosocial safety management, coaching, and related services (the "Services") to you ("you" or "your"). Gentia is operated by balance2life Pty Ltd ("we," "us," or "our"), an Australian company.
What We Expect From You
Report Inappropriate Content
If you see any inappropriate messages, behaviour, or content, please notify both your Organisation (defined below) and Gentia at hello@gentia.ai.
Be a Good User
- Do not use, share, or transmit any content that violates your Organisation's rules.
- Treat others with respect and refrain from offensive, discriminatory, obscene, or harassing language or behaviour.
- Respect the rights of others, including privacy, intellectual property rights, and confidentiality.
Do Not Violate Any Laws
- Comply with all applicable laws and regulations.
- Do not spam or interfere with the operation of the Services.
- Do not use automated methods to collect data, or access information you are not authorised to see.
- Do not misrepresent your identity or impersonate another person.
- Do not copy our ideas, features, or functions in order to build a competing product.
Keep Your Account Secure
- Protect your account credentials (for example, your password).
- Notify Gentia promptly at hello@gentia.ai if you suspect any security breach.
Age Restriction
You must be at least 18 years old to use the Services.
How the Services May Not Be Used
Gentia is designed to identify and address psychosocial risks in the way work is designed and managed. It is not a performance management, disciplinary or surveillance tool. The Services must not be used to:
- Monitor, investigate or build a case against an individual worker.
- Make or support disciplinary, performance management, promotion or termination decisions about an individual.
- Attempt to re-identify individuals from aggregated or de-identified findings.
- Pressure, penalise or retaliate against anyone for what they have contributed through the Services.
If we become aware that the Services are being used in these ways, we may suspend access in accordance with Your Organisation's Agreement.
What You Can Expect From Us
- We do not sell your personal information.
- We do not share information that identifies you with advertisers or advertising networks, and we do not run third-party advertising or visitor-tracking scripts.

Feedback
If you provide feedback or suggestions regarding the Services, Gentia will own all rights to that feedback and may use it for any purpose, without obligation to you.
Your Organisation
"Your Organisation" is the company or group (for example, your employer) that has given you access to the Services within a unique Gentia domain. That Organisation either has a written contract with us or has agreed to our online Platform Service Agreement ("Your Organisation's Agreement").
Ownership of Data
- Your Organisation owns any content or information ("Your Organisation's Data") you provide.
- Your Organisation manages who can access this Data, can add or remove users, and can set data retention and export policies.
Your Organisation's Responsibilities
- It is up to Your Organisation (not Gentia) to ensure the lawful processing of Your Organisation's Data.
- Your Organisation must provide any disclosures or obtain any consents needed to process Your Organisation's Data, including any consultation obligations under applicable work health and safety law.
- Direct any questions about Your Organisation's policies or data handling to the appropriate person in that Organisation.
Disclaimer
Except as set out below, and to the maximum extent permitted by law, the Services are provided on an "as is" and "as available" basis, and Gentia excludes all representations and warranties of any kind, whether express or implied.
Nothing in this AUP excludes, restricts or modifies any guarantee, right or remedy you may have under the Australian Consumer Law or any other law that cannot lawfully be excluded or limited. Where our liability cannot be excluded, it is limited to the maximum extent permitted by law.
The Services support psychosocial safety decision-making. They do not constitute legal, medical or psychological advice, and they do not replace the professional judgment of the people who use them.
Account Termination
If you want to terminate your account, please contact Your Organisation. If Your Organisation ends your access or removes you from its domain, your account will be terminated in accordance with Your Organisation's Agreement.
Changes to This AUP
We may update or modify this AUP from time to time. If we make a material change, we will notify you (for example, via email or a message in the Services) before the update takes effect. If you continue using the Services after the effective date, you are deemed to have accepted the revised AUP.
Governing Law and Venue
This AUP and any related disputes are governed by the governing law set out in Your Organisation's Agreement, without regard to conflicts-of-laws rules. Any legal actions must be brought in the jurisdiction specified in that Agreement, and you submit to the exclusive jurisdiction of those courts.
Where Your Organisation's Agreement does not specify a governing law — or where you are using the Services other than through an Organisation — this AUP is governed by the laws of New South Wales, Australia, and you submit to the exclusive jurisdiction of the courts of New South Wales.
Assignment
You may not assign any rights or obligations under this AUP without our prior written consent, which will not be unreasonably withheld. We may freely assign this AUP, including all related policies and documentation, without notice.
